A written tenancy agreement is a contract between a landlord and a tenant that outlines the rights, responsibilities, terms, length and restrictions of the tenancy in a way that is legally enforceable. This keeps disputes to a minimum as both parties will know where they stand.

When this happens, because of our litigation background, Proctor Moore is skilled at settling disagreements. There are several ways in which we can help from informing you of your legal rights and obligations, negotiating a mutually acceptable solution or even taking your case to court.

Landlord Assistance for Problem Tenants

After speaking with many of our clients who are landlords, we found that there was a reoccurring problem. You told us that there are too many tenants who simply won't pay. In this case we offer 3 fast, simple and cost effective options for tenant evictions.

Stage 1: Serving Notice
Fixed Fee £100.00 excluding VAT

We will arrange for a notice to be served on your tenant to leave the property. This stage includes taking your instructions, preparing the notice and arranging for an independent process server to deliver the notice. They will also prepare a witness statement to confirm delivery. This is when most tenants realise just how serious you are and in many cases it's the only stage needed.

Stage 2: Obtaining the Possession Order
Fixed Fee £750.00 excluding VAT

We will issue proceedings and obtain an order that the tenant gives up possession of your property. This stage includes preparing all court papers, getting a court date set and arranging for a barrister to attend to obtain the possession order from a judge . In some cases a barrister's attendance will not be required and this can save time.

Stage 3: Warrant for Evection
Fixed Fee £100.00 excluding VAT

This final stage is when the tenant still ignores the court order and refuses to go. A warrant for evection is an appointment made by the court bailiff to attend the property and remove the tenant, with or without the tenant's consent, and finally get you your property back.

If the matter becomes defended then our firm will have to revise the cost position and provide further fixed fee.
